This article critically examines the rationales for the well-settled principle in sentencing law that an offender’s remorse is to be treated as a mitigating factor. Four basic types of rationale are examined: remorse makes punishment redundant; offering mitigation can induce remorse; remorse should be rewarded with mitigation; and remorse should be recognised by mitigation. The first three rationales each suffer from certain weaknesses or limitations, and are argued to be not as persuasive as the fourth. The article then considers, and (...) rejects, two arguments against remorse as a mitigating factor in sentencing: that the crime, not the offender, is the focus of punishment; and that the truly remorseful offender would not ask for mitigation. The article concludes with a brief consideration of whether a lack of remorse should be an aggravating factor. (shrink)

This study introduces a hybrid neuro-symbolic framework that achieves deterministic detection of statutory inconsistency in complex law. We use the U.S. Internal Revenue Code (IRC) for our investigation because its complexity makes it a fertile domain for identifying conflicts. Our research advances a solution for detecting inconsistent provisions by combining Large Language Models (LLMs) with a symbolic reasoner. To evaluate this approach, we conducted experiments using GPT-4o, GPT-5, and Prolog. First, we used GPT-4o to translate IRC Section 121 into formal (...) Prolog rules, which were then refined in the SWISH environment. Next, these rules were incorporated into GPT-4o prompts to test whether Prolog-augmention would improve the ability to detect legal inconsistencies. The results show that Prolog augmentation did not improve the model’s success rate. Whether relying on natural language alone or using the Prolog-augmented prompts, GPT-4o only detected the inconsistency in one out of three testing strategies, resulting in a low 33% accuracy rate. Furthermore, the model’s underlying reasoning was actually worse when using the augmented prompts: the natural-language approach achieved 100% rule coverage, whereas the Prolog-augmented approach only reached 66%, indicating that the model missed critical steps in its statutory analysis. In contrast to probabilistic prompting, the hybrid Prolog model produced deterministic and reproducible results. Guided by GPT-5 for refinement, the model formalized the IRC section’s competing interpretations and successfully detected an inconsistency zone. Validation tests confirm that the Prolog implementation is accurate, internally consistent, deterministic, and capable of autonomously identifying inconsistencies. These findings show that LLM-assisted formalization, anchored in symbolic logic, enables transparent and reliable statutory inconsistency detection. (shrink)

This article examines what repentance might mean on the part of conscientious violent extremists, who commit very serious violent crimes, intending their acts to advance a political or ideological cause and firmly believing their acts to be morally permitted or required. The article looks at remorse, repudiation of one’s conduct, repudiating aspects of the self, and resolving to make amends. The article presents a modest conception of what should be accepted as repentance in such contexts. Repentance can come in degrees, (...) and it should usually be enough that the extremist is genuinely remorseful and repudiates their violent actions against innocent people, even if it would be better in many cases if they also abandoned extremist thinking and dropped their commitment to their ultimate cause. Counterfactual thinking involves the imagination of non-factual alternatives to reality. We investigated the spontaneous generation of both upward counterfactuals, which improve on reality, and downward counterfactuals, which worsen reality. All subjects gained $5 playing a computer-simulated blackjack game. However, this outcome was framed to be perceived as either a win, a neutral event, or a loss. "Loss" frames produced more upward and fewer downward counterfactuals than did either "win" or "neutral" frames, but the overall prevalence of counterfactual thinking did not (...) vary with outcome valence. In addition, subjects who expected to play the game again made more upward counterfactuals and were less satisfied with the outcome than were subjects who did not expect to play again. However, once subjects saw the cards from which they could have selected had they "hit" again (two winning cards and two losing cards), all subjects generated primarily upward counterfactuals and showed a corresponding decrease in satisfaction. These results implicate both cognitive and motivational factors in the generation of counterfactuals and tell us something about the functional value of counterfactual thinking: downward counterfactuals provide comfort; upward counterfactuals prepare one for the future. Effects of perceived control and close alternative outcomes were examined. Subjects played a computer-simulated "wheel-of-fortune" game with another player in which two wheels spun simultaneously. Subjects had either control over spinning the wheel or control over which wheel would determine their outcome and which would determine the other player's outcome. Results showed that (a) subjects generated counterfactuals about the aspect of the game that they controlled, (b) the direction of these counterfactuals corresponded to the close outcome associated with the aspect (...) they controlled, and (c) close counterfactuals predicted affective responses to the outcome of the wheel spin. Cognitive and motivational implications of the influence of perceived control on counterfactual generation are discussed. (shrink)

Human stories lie at the heart of professional practice in the human, social services, though these are often discounted when it comes to researching such services and sharing practice through publication. This article identifies and addresses certain methodological and epistemological biases and consequent challenges in human science research, and discusses the importance of story (autoethnography) and discovery (heuristics) in research which can inform practice, meaningfully and ethically. It considers this by addressing both research and publication, illustrating both the challenges and (...) the solutions from the authors’ own experiences. The article argues for reclaiming the subjective and the subjectivist dimension in human, social science, and, therefore, the experiential, in both research and publication; and addresses four problems with regard to publishing in the human sciences, namely: privilege, quality, anonymity in peer-review, and capital. This article replies to some of Richard Lippke’s criticisms of my earlier article on the issue of whether remorse should mitigate sentence. I query whether remorse-based mitigation must always wait for signs of moral reform, and re-affirm that remorse is worthy of recognition in itself and not just for the moral reform it may bring. I also argue that, where delayed mitigation is appropriate, the task of ascertaining moral reform is not as dubious, practically or in principle, as Lippke maintains. (...) This study explores the prevalence and predictors of three sexual contact and conduct risks through mobile phone use among adolescents (N = 540): (1) the exchange of sexually explicit content, (2) the sharing of one's mobile phone number with a stranger from the opposite sex, and (3) participation in anonymous chat rooms on TV. One in three adolescents admits having exchanged sexual content, one in five reports having shared their number with a stranger, and one in ten has participated in (...) TV chat rooms. Contextual predictors were gender, age, having a (romantic) partner, self-esteem, popularity, susceptibility to peer pressure, parent attachment and attitude towards school. Strong mobile phone use predictors were the frequency of text messaging, problematic phone use and using one's phone to avoid face-to-face interactions. However, different patterns emerged for the different mobile phone practices and for girls and boys, indicating the need for further research. (shrink)

In a companion review1 we discussed the data supporting the conclusion that at least two subtypes of spectrin exist in mammalian brain. One form is found in the cell bodies, dendrites, and post‐synaptic terminals of neurons (brain spectrin(240/235E)) and the other subtype is located in the axons and presynaptic terminals (brain spectrin(240/235)). Our recent understanding of brain spectrin subtype localization suggests a possible explanation for a conundrum concerning brain 4.1 localization. Amelin, an immunoreactive analogue of red blood cell (rbc) cytoskeletal (...) protein 4.1, is localized in neuronal cell bodies and dendrites when brain sections are stained with antibody against rbc protein 4.1. However, it has recently been suggested that synapsin I, a neuron‐specific phosphoprotein associated with the cytoplasmic surface of small synaptic vesicles, is related to erythrocyte 4.1. In this review we hypothesize that there are at least two forms of brain 4.1: a cell body/dendritic form (amelin) which is detected with rbc protein 4.1 antibody, and a unique form found exclusively in the presynaptic terminal (synapsin I). The binding of synapsin I to brain spectrin(240/235), and its ability to stimulate the spectrin/F‐actin interaction in a phosphorylation‐dependent manner suggests a model for the regulation of synaptic transmission mediated by the neuronal cytoskeleton. Richard Kearney has always insisted that his anatheistic approach to a phenomenology of the sacred stipulates a close connection with aesthetics. He supports this contention throughout his work by constantly referencing important artists, poets, novelists, and film makers. Indeed, this connection between aesthetics and his philosophy of religion has even motivated an anthology of articles entitled The Art of Anatheism. Consequently, in this essay I wish to expand that connection by examining the relationship between Kearney’s anatheism and the ‘supreme fiction’ (...) of the American poet Wallace Stevens. To accomplish this expansion, I inspect several topics shared by the two authors, including God, faith, imagination, and ‘negative certainty’. This last topic forms something of the central focus of the essay, since I argue that the affirmative humility of faith professed by both never avoids the ‘void’ inherent in human existence that disallows every claim to the ‘innocence of an absolute’. Christopher Southgate has made important contributions to theodicy and the theory of divine action in light of the contingency in evolution and the suffering of creation. What happens then when one thinks through the implications of contingency for Christology? One can admit that aesthetic and moral judgments are products of a contingent history and yet affirm that they really are valid. Similarly, we argue, one can acknowledge the contingency of Jesus’ existence, actions, and subsequent impact and still maintain that his (...) will was uniquely united with the divine will. Following a critical engagement with the recent work of Keith Ward, we argue that a high Christology is compatible with the actual contingencies of evolutionary and social history, without the necessity of interventionist divine action. As we think about the story of the life of the artist, the grand aesthetic act of the exemplarization of the experiences of (...) life that completes the life, it is essential to address the position of death in art, beauty, and the story of life. Death completes the story of a life and adds value and sometimes beauty to a life. The discussion of death reveals something fundamental to our understanding of aesthetics. It reveals that as we exemplarize our experiences of our actions, and especially those moments of the reconfiguration of experience to create the form and content of art, world, and self, we find the source of value in art and beauty in life. In order to fully understand the ethical, cultural, and political debate that moves around the papillomavirus vaccine, a bit of attention has to be paid to its history.In 2006 the first advertisements for Gardasil, the commercial name of the vaccine, started to appear in the United States. Merck pharmaceutical was the main dealer. Their “One Less” campaign was characterized by adolescent girls staring into the camera and saying, “I’m one less,” declaring their intention to be vaccinated against the human papillomavirus, (...) and to be one less victim of cervical cancer; all it would take was three injections over six months. A few months after the appearance of the advertisement, the HPV matter took another turn when Texas Governor Rick Perry decided to issue an executive order mandating vaccination of all sixth-grade girls in the state. Texas, a state with a conservative political culture and well-organized anti-vaccination movement, bypassed the legislature, overturned Perry’s order .. (shrink)

Steven Tudor defends the mitigation of criminal sentences in cases in which offenders are genuinely remorseful for their crimes. More than this, he takes the principle that such remorse-based sentence reductions are appropriate to be a ‘well-settled legal principle’—so well settled, in fact, that ‘it is among those deep-seated commitments which can serve to test general theories as much as they are tested by them’. However, his account of why remorse should reduce punishment is strongly philosophical in character. (...) He sets to one side the many practical difficulties in implementing such reductions in the real world of criminal justice institutions so that he can focus on the question of whether a plausible account of sentencing can show that remorse should mitigate punishment. I contend that Tudor’s defense of such reductions is unpersuasive in certain respects. Yet even if it can be made more persuasive, I argue that the conditions that would have to be satisfied for remorse-based sentence reductions to be justifiably implemented are so many and various that they would likely exceed our abilities to responsibly grant them in real world legal contexts. I therefore claim that Tudor has failed to provide a defense of the ‘remorse principle’ that serves to explain or justify existing legal practices. (shrink)

Foundation courses often review historical and philosophical information, allow students to develop their own justifications regarding why music should be part of a school program, and present information regarding practical issues in the music teaching profession including assessment, planning for instruction, use of technology, and working with diverse learning situations.Because the curricular content within given foundation courses can be quite varied, finding a text that is broad enough to cover the myriad of topics that might be addressed in this type of course yet detailed enough to make each topic meaningful is a true challenge. The idea that we might be robots is no longer the stuff of science fiction; decades of research in evolutionary biology and cognitive science have led many esteemed scientists to the conclusion that, according to the precepts of universal Darwinism, humans are merely the hosts for two replicators (genes and memes) that have no interest in us except as conduits for replication. Richard Dawkins, for example, jolted us into realizing that we are just survival mechanisms for our own genes, sophisticated (...) robots in service of huge colonies of replicators to whom concepts of rationality, intelligence, agency, and even the human soul are irrelevant. Accepting and now forcefully responding to this decentering and disturbing idea, Keith Stanovich here provides the tools for the "robot's rebellion," a program of cognitive reform necessary to advance human interests over the limited interest of the replicators and define our own autonomous goals as individual human beings. He shows how concepts of rational thinking from cognitive science interact with the logic of evolution to create opportunities for humans to structure their behavior to serve their own ends. This book derives from a 1993 National Endowment for the Humanities Summer Institute on Knowledge, Teaching, and Wisdom. The Institute took place at the University of California, Berkeley, and was co-directed by Keith Lehrer and Nicholas D. Smith. The aims of the Institute were several: we sought to reintroduce wisdom as a topic of discussion among contemporary philosophers, to undertake an historical investigation of how and when and why it was that wisdom faded from philosophical view, and to ask (...) how contemporary epistemological theories might apply to the obviously related subjects of teaching and wisdom. In recruiting participants, Lehrer and Smith put the greatest emphasis on those with professional interests in epistemology and the history of philosophy, of the ancient Greeks especially ancient Greek philosophy (because in the writings all three subjects of the Institute were explicitly related and discussed). But in addition to these two groups, some effort was made also to include others, with academic specializations in a variety of fields other than epistemology and the history of philosophy, to ensure that a broad perspective could be achieved in our discussions. To an obvious extent, the papers in this book reflect the recruitment emphases and variety. They also testify to the extent that the Institute managed to bring life to our subjects, and to raise very old questions in a contemporary context. (shrink)

This chapter outlines the growth of Murdoch’s standing in twenty-first-century critical acclaim and analyses her unique philosophical and literary contribution to contemporary thought, including her influence on the ‘ethical turn’ in literature and her interaction with her readers, before identifying the centrality of remorse in her work. Murdoch’s fiction abounds in images of remorse, augmenting the literary tradition she inherits by adding fresh imaginative material to the theme of remorse which runs through Shakespeare, Eliot, Dostoevsky, James, and Conrad. After tracing (...) the development of remorse studies and identifying the leading theorists working in this area (Christopher Cordner, Murray Cox, Raimond Gaita, Michael Proeve, Mark Stern, Alan Thomas, and Steven Tudor), the vocabulary and concepts involved in this theoretical discourse are clarified, differentiating remorse from regret, guilt, and shame and distinguishing chronic remorse from lucid remorse. A dialogue between Murdoch’s thought and Simone Weil’s work on affliction is begun. It is argued that in Murdoch’s view remorse is a non-substitutable index of moral sensibility because, at its lucid best, remorse produces that attention to the reality of the other which Murdoch defines as love.
